Access to justice in india: an agglomeration of procedural complexities and unawareness

Abstract

Justice is the foundation stone of human society. From times immemorial democracy had stood on pillars of Justice. Concept of Justice is very dynamic in nature and has been a changed from time to time. Justice is 21stcentury has enhanced it dimension from being a thing ‘simply just’. However this demand for justice is often unfulfilled in India. Excess procedural formalities delay the justice to the point that it gets denied. Justice has become an instrument only for those who can afford to get it. Many cases die out in initial stages due to lack of awareness and fright of the procedure. Many cases do not even get reported due to complexities present in justice system. It has been observed that many innocent get punished due to inaccessibility of higher courts. Activism showed by media has stimulated the justice machineries however there are many flaws in the solution which misleads the justice system.

Targeting the aforesaid condition the research has been made on doctrinal model by collecting data from primary and secondary sources. The research aims to highlight the justice administrating bodies that are created for helping those who cannot reach justice. The research projects the hindrance faced by the people before and after reaching for justice administrating bodies. The research highlights the procedural problems faced by the people and critically projects the deficiency on initial stages of complains and procedure thereafter. The research highlights the problem faced by the under trails and flaws in the trail procedures. The research projects the justice scenario of modern India with reference to the new trend for demand of justice by mass protest. The research critically examines the speedy modes of justice available in India. In the end it provided certain solutions for justice system reaching those who are unable to reach it.
