Abstract This paper focusses on the medical tourism with special reference to various challenges to right to health in globalized world. Although there are few existing laws that prescribe standards of care by medical practitioners, there is a need to have and express law that protects and safeguards patient rights of those coming from other countries for treatment in India. While there are well developed malpractice laws in many developed countries in India the protection available is nowhere near. There is a need to provide more transparency in the health care sector from the government.
