Rape - A Crime, not against an Individual alone, but against the whole Society Kamalesh Sanjana Student, School of Law, Christ University, Bangalore, Karnataka, India Online published on 6 August, 2014. Abstract Every day, every minute, every second a woman is ‘raped’ at any place around the world. Whether a new born girl, an adolescent, a mid-aged woman, or an old woman, irrespective of their age women are, ‘raped’. This crime has grown to a mammoth level because of weak laws and an ineffective, long, cumbersome implementation system for the same, in turn unsuccessful in serving the ends of justice; this is regarded as the greatest lacunae, obstructing the access to a better and strong criminal justice system. This paper is written to understand the crime “Rape”, the author seeks to analyse questions: What is Rape? Why are women Raped? What is the mental status of the rapist, which motivates him to commit the crime? What is the effect of this crime on the victim?
The author has related rape and forensic sciences and has highlighted the investigation process. A comparison of punishments for rape in India and other countries is also concentrated on. And a focus on the recent developments in criminal law post the Delhi Rape Incident in India, leading to amendments to the present criminal laws is also dealt with.
